Litigation

The process of resolving disputes by filing or answering a complaint through the public court system. The nature of this complaint (including the probable outcome for each side) becomes the basis for any settlement negotiaton.

In federal courts, litigation is also governed by a number of federal rules: the Federal Rules of Civil Procedure, the Federal Rules of Criminal Procedure, the Federal Rules of Appellate Procedure, the Federal Rules of Bankruptcy Procedure, and the Federal Rules of Evidence. These are supplemented by the local rules of each court and the standing orders of judges.
